By accessing or using 24CallDesk's AI-powered phone system and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Services.
Description of Services
24CallDesk provides an AI-powered virtual receptionist and phone management platform that includes:
- Automated call answering and routing
- Call recording and transcription services
- CRM integration and data management
- SMS and messaging capabilities
- Appointment scheduling and calendar integration
- Analytics and reporting tools
Account Registration and Security
Registration Requirements
To use our Services, you must:
- Be at least 18 years old
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Use the Services for lawful business purposes only
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
Acceptable Use Policy
You agree not to use our Services to:

Subscription and Payment

Free Trials

Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period.
Call Recording and Consent
Our Services include call recording functionality. You are responsible for:
- Complying with all applicable laws regarding call recording and consent
- Obtaining necessary consent from call participants where required
- Providing appropriate notifications about recording practices
- Using recorded calls in accordance with privacy laws and regulations
Intellectual Property Rights
24CallDesk retains all rights, title, and interest in:
- The Services and underlying technology
- Our trademarks, logos, and branding
- All software, algorithms, and AI models
- Documentation and training materials
You retain ownership of your business data and content. By using our Services, you grant us a license to process and store your data solely to provide the Services.
Data Protection and Privacy
Our collection and use of your data is governed by our Privacy Policy. We implement appropriate security measures to protect your data, but cannot guarantee absolute security.
Service Availability and Support
We strive to provide reliable service but do not guarantee:
- Uninterrupted or error-free service
- Specific uptime percentages (except where SLAs apply)
- Compatibility with all devices or systems
We provide customer support via email and may offer additional support channels based on your subscription plan.
Disclaimers and Limitations
Service Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 24CALLDESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Indemnification
You agree to indemnify and hold harmless 24CallDesk from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the Services or violation of these Terms.
Termination
We may terminate or suspend your account and access to the Services:
- For violation of these Terms
- For non-payment of fees
- For fraudulent or illegal activity
- At our discretion with or without cause
Upon termination, your right to use the Services will immediately cease. We may delete your data after a reasonable grace period.
Dispute Resolution
Any disputes arising from these Terms or the Services shall be resolved through:
- Good faith negotiation between the parties
- Binding arbitration if negotiation fails
- Governed by the laws of the State of California
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and 24CallDesk
- Severability: If any provision is found unenforceable, the remaining provisions will remain in effect
- Waiver: Our failure to enforce any right or provision does not constitute a waiver
- Assignment: You may not assign these Terms without our consent
